These Beta Terms govern your access to and use of the Willder Service while it is offered as a beta, preview, or early-access release (the "Beta Service"). They supplement the Terms of Service and, for the duration of the beta, control in the event of a conflict. Capitalized terms not defined here have the meanings given in the Terms of Service. "You" and "Willder" are as defined there.
By using the Beta Service, you agree to these Beta Terms.
1. Beta status
The Beta Service is a pre-release version made available so you can try it and give us feedback. It is under active development, is not generally available, and may:
- contain bugs, errors, and incomplete or changing features;
- behave unpredictably, lose data, or become unavailable without notice;
- change materially, or be discontinued, at any time.
You should not use the Beta Service for anything you cannot afford to lose or for any mission-critical, high-risk, or regulated purpose. Keep your own copies of anything important.
2. No fees
The Beta Service is provided free of charge. We may introduce fees for future versions; if we do, we will give you notice before any charges apply to you, and you may stop using the Service instead of accepting them. Providing the Beta Service for free is part of the consideration for the "as-is" and liability terms below.
3. No SLA, support, or availability commitment
We provide the Beta Service with no service-level agreement, no uptime or performance guarantee, and no committed support. We may provide informal support at our discretion (reach us at legal@willder.ai). We may throttle, suspend, modify, or shut down the Beta Service, in whole or in part, at any time and without liability.
4. Feedback
We want your feedback. If you give us suggestions, ideas, bug reports, or other feedback about the Beta Service ("Feedback"), you grant Willder a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, disclose, reproduce, and otherwise exploit the Feedback for any purpose, without obligation or attribution to you. Feedback is provided voluntarily and is not your Confidential Information. We may contact you about your Feedback and your use of the Beta Service.
5. Confidentiality of the Beta
The Beta Service, its features (including any not yet publicly announced), performance, and any non-public information we share about it are our Confidential Information. You will not disclose them to third parties or publish benchmarks, screenshots, or evaluations of the Beta Service without our prior written consent, except as the Terms of Service permit. This section does not restrict you from disclosing your own Customer Content or from describing that you are a Willder beta user.
6. Your data during the beta
- You still own your Customer Content, and our handling of it is governed by the Privacy Policy and, where applicable, the DPA.
- Because the Beta Service is under development, the risk of data loss or corruption is higher than in a generally available product. We are not liable for lost or corrupted Customer Content, and you are responsible for maintaining your own backups of anything important.
- When the beta ends or your access is terminated, we may delete Beta Service data. We will try to give you a reasonable opportunity to export important Customer Content, but do not guarantee migration to any future version.
7. As-is; disclaimers; liability
THE BETA SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, as more fully set out in the Terms of Service. The limitation of liability in the Terms of Service applies to the Beta Service; because the Beta Service is free, you acknowledge that our total aggregate liability is capped at US $100 as described there.
8. Term and termination
These Beta Terms apply for as long as you have access to the Beta Service. Either party may terminate participation at any time and for any reason. On termination or when the beta ends, your access stops and Sections 4 (Feedback), 5 (Confidentiality), 6 (data), and 7 (as-is; liability) survive.
9. Transition to general availability
If and when Willder becomes generally available, continued use may require you to accept updated terms (and, if applicable, paid plans). Nothing here obligates us to release a generally available version or to migrate your Beta Service data to it.
